Privacy Policy
1. Controller
The controller within the meaning of the General Data Protection Regulation (GDPR) is: bytebrise, Marketing und Design Jakob Serfözö Balduin-Helm-Straße 71b 82256 Fürstenfeldbruck, Germany Email: [email protected] Phone: +49 8141 5098988
2. Hosting and spam protection (Cloudflare)
This website is delivered via Cloudflare (proxy and CDN) and runs on a server provided by Hetzner in Germany / the EU.
When you access the website, technically necessary data is automatically collected, in particular the IP address, date and time of access, and the file requested. The legal basis is our legitimate interest (Art. 6(1)(f) GDPR) in the secure and stable operation of the website.
To protect the check form against automated requests (spam, abuse) we use Cloudflare Turnstile (provider Cloudflare, Inc., USA). As soon as the email field appears in the form, your browser loads a script from challenges.cloudflare.com. Cloudflare processes your IP address and browser and device information to detect whether a request comes from a human; we verify the resulting token server-side with Cloudflare, sending your IP address along. The legal basis is our legitimate interest in protection against abuse and spam (Art. 6(1)(f) GDPR); insofar as your device is accessed for this, it is strictly necessary for the service you requested (Section 25(2) No. 2 TDDDG). Transfer of data to the USA cannot be excluded. More information: https://www.cloudflare.com/privacypolicy/
3. Cookies, language choice, Google Ads, Meta Pixel and OpenAI ads pixel
Without your consent we set no analytics or marketing cookies and load no advertising tags (Google, Meta, OpenAI). Before your consent we store only two technically necessary items on your device: first, your cookie choice in your browser's local storage (entry "namedly_consent", valid for 180 days) and second, only if you click the language switch, your language choice in a cookie ("nl_lang", value "de" or "en", valid for one year). Both are strictly necessary for the service you requested (Section 25(2) No. 2 TDDDG; legal basis of the processing Art. 6(1)(f) GDPR). Otherwise: storing information on your device, and accessing information already stored there, generally requires your consent under Section 25 TDDDG (Germany's Telecommunications Digital Services Data Protection Act), unless strictly necessary.
To measure our own Google ads we use Google Ads conversion tracking (gtag.js, conversion ID AW-18125103490; provider Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland) with Google Consent Mode v2. The tag only loads once you have chosen "Accept all" in the cookie banner (legal basis Art. 6(1)(a) GDPR, consent; Section 25(1) TDDDG); no data is transmitted to Google before you consent. After your consent Google may set cookies and process, among other things, your IP address and information about your visit; transfer to the USA cannot be excluded.
To measure our own Meta ads (Facebook/Instagram) we use the Meta Pixel (provider Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland; further processing by its parent company Meta Platforms, Inc., USA, is possible). Like the Google tag, the Meta Pixel only loads once you have chosen "Accept all" in the cookie banner (legal basis Art. 6(1)(a) GDPR, consent); no data is transmitted to Meta before you consent. The Meta Pixel sets cookies and collects, among other things, your IP address, device and browser information, and your interaction with our website (page view, starting a check, purchase) to measure the effectiveness of our advertising. Processing in the USA cannot be excluded; Meta Platforms Ireland Limited relies on EU Standard Contractual Clauses (SCCs) for this purpose.
To measure our own ads at OpenAI we use the OpenAI ads pixel (provider OpenAI, USA; script from bzrcdn.openai.com). It likewise loads only once you have chosen "Accept all" in the cookie banner (legal basis Art. 6(1)(a) GDPR, consent; Section 25(1) TDDDG); no data is transmitted to OpenAI before you consent. After your consent the pixel transmits information about your visit (including your IP address, device and browser information, and the event that you completed a free check) to OpenAI to measure the effectiveness of our ads. The transfer is to the USA. More information: https://openai.com/policies/privacy-policy/
Your consent covers Google, Meta and OpenAI together and can be withdrawn at any time with effect for the future via the "Cookie settings" link in the footer; after withdrawal, scripts are no longer loaded on the next page view. More information: https://policies.google.com/privacy and https://www.facebook.com/privacy/policy/
4. Audience measurement with Matomo (cookieless)
In addition to the consent-based advertising tools described in section 3, we use Matomo for anonymous audience measurement, an open-source analytics application that we host ourselves (Hetzner, Falkenstein, Germany). No data is transferred to third parties or abroad.
Matomo is configured cookieless on this website (disableCookies) and honors your browser's Do Not Track header; if it is sent, tracking disables itself automatically. The last two octets of your IP address are discarded before any processing, and the full IP address is never stored. We collect page views, referrer, an approximate location (country/region derived from the anonymized IP), screen resolution, and browser/operating-system type. This does not create personal profiles or cross-site tracking.
The legal basis is Art. 6(1)(f) GDPR (legitimate interest in audience measurement); no cookie consent banner is required, as neither cookies nor local storage are accessed (Section 25(2) No. 2 TDDDG). You can object to this measurement at any time by enabling the Do Not Track header in your browser. Manufacturer: InnoCraft Ltd, 7 Waterloo Quay PO625, 6140 Wellington, New Zealand; namedly.io, however, runs a self-hosted instance, so no data is transmitted to InnoCraft.
5. Processors for the audit check
For the AI visibility check, we transmit the information you enter (e.g. website address, industry, city) to the AI providers we use, namely OpenAI, Anthropic, Google (Gemini) and Perplexity, for automated analysis. The legal basis is the performance of the check you requested (Art. 6(1)(b) GDPR).
Data processing agreements with the processors we use are in place or will be concluded pursuant to Art. 28 GDPR. As some of these providers are based outside the EU, transfers rely on EU Standard Contractual Clauses (SCCs) or comparable safeguards.
Inquiry data that does not lead to a purchase is deleted after 12 months.
6. Payment processing
We use the payment provider Stripe (Stripe Payments Europe, Ltd., Ireland, and Stripe, Inc., USA) to process payments for the full audit. When you make a payment, your payment data is transmitted directly to Stripe and processed there. The legal basis is the performance of the contract (Art. 6(1)(b) GDPR). For transfers to the USA, Stripe relies on EU Standard Contractual Clauses (SCCs).
7. Contact
If you contact us by email, we process the data you provide to handle your request. The legal basis is Art. 6(1)(b) or (f) GDPR.
Withdrawal from a contract: If you use the “Withdraw from contract” function, we store your name, your contract details, your email address and the time of receipt, and we send you an acknowledgement of receipt by email. The legal bases are Art. 6(1)(c) GDPR together with Section 356a BGB and Art. 6(1)(b) GDPR (unwinding the contract).
8. Your rights
You have the right to access, rectification, erasure, restriction of processing, data portability, and objection to the processing of your personal data. You may withdraw any consent given at any time with effect for the future.
You also have the right to lodge a complaint with a data protection supervisory authority, in particular the Bavarian State Office for Data Protection Supervision (BayLDA).
9. Encryption
For security reasons and to protect the transmission of confidential content, this website uses SSL/TLS encryption.
